Acceptance of the Terms and Conditions of Sale
These general terms and conditions of sale govern all transactions conducted with Les Tables de Joséphine, hereinafter referred to as “LTDJ.” By placing an order, the customer acknowledges having read and accepted these terms and conditions.
Rates
Prices exclude insurance and transportation and are based on the expected duration of use as specified in the quote. Any excess will be billed accordingly. The return date and time are imperative.
Orders and Payments
To confirm a rental order, a deposit equivalent to 30% of the total rental amount is required.
Full payment is due before delivery or upon receiving the rented items, unless otherwise agreed in writing.
LTDJ’s general rental terms, as defined, are accepted upon accepting the quote.
Cancellation
Total or partial cancellation of an order will be charged at a minimum of half the order amount, in addition to any already incurred expenses.
Transport
Delivery and pickup charges will be invoiced according to our scale.
Delivery and return charges are the customer’s responsibility, unless otherwise stated.
Delivery times will be agreed upon at the time of the order.
Items must be returned in the same condition as at the time of delivery. Any damage or loss will incur additional charges.
Any additional handling not specified in the initial quote will also be billed.
Dish Pickup
Dish pickup can be arranged at one of the following addresses:
- 25 Antoine Labarre Street, 1050 Brussels (Free)
- 83b Tenbosh Street, 1050 Brussels (Free)
Delivery to the event location to be defined in the quote.
Guarantee
A guaranteed amount will be requested from the customer, which will only be returned after inspection upon the return of the equipment and payment of the invoices.
Provision and Return
The customer must be present during delivery and return. The equipment must be returned in good condition, sorted, and packaged in accordance with hygiene and safety standards.
Cleaning and Maintenance of Products
When returning rental products, it is essential that the tableware and table decoration are in an appropriate condition. If the tableware is returned dirty, the cleaning cost will be included in the invoice price. We encourage you to follow the washing instructions provided by Les Tables de Joséphine to avoid damaging the products. Most of our items are intended for hand washing. If products are returned damaged due to improper use or improper washing, fees will be charged accordingly. Please take great care of the items you rent to maintain their quality and durability.
Use and Damages
The customer agrees to use the equipment in accordance with its original purpose and to protect it from any damage. No modifications can be made to the equipment.
Invoicing and Payment
Invoices are issued upon delivery or after the service. Payment must be made by the due date on the invoice. In case of delay, late fees will be applied.
Ownership Reserve
The equipment remains the property of LTDJ until full payment is received. It can be opposed to creditors in the event of a collective procedure.
Designation
The term “equipment” refers to all pieces and accessories rented, as indicated in the quote and order.
The customer placing the order is the lessee, and the lessor is Les Tables de Joséphine (LTDJ).
Intellectual Property, Use, and Confidentiality
Intellectual property rights remain the property of LTDJ. Both parties guarantee the confidentiality of information obtained during the order.
The rented equipment remains the property of LTDJ.
The customer agrees to use the equipment under normal conditions of use, in accordance with its initial purpose.
The customer is prohibited from moving, transferring, or subleasing the equipment without prior agreement.
Force Majeure
LTDJ cannot be held responsible for delays or delivery failures due to force majeure.
LTDJ cannot be held responsible for exceptional events (strikes, accidents, inclement weather, etc.) preventing the execution of services.
Ownership, Liability, and Insurance
The rented equipment remains the property of LTDJ, and the customer must obtain insurance to cover their liability. The customer is responsible for the rented equipment for the entire rental period.
LTDJ disclaims all responsibility in case of improper use of the equipment.
The customer is responsible for reporting any hidden defects in the equipment upon receipt.
The customer is responsible for the protection of the equipment and must adhere to safety instructions.
Protection of Personal Data
LTDJ commits to respecting the confidentiality of the customer’s personal data and using it only for the purpose of the service. The customer can exercise their rights regarding their personal data.
Jurisdiction
Any dispute related to the TCS is subject to Belgian law.
In case of a dispute, the competent jurisdiction is the Commercial Court of Brussels.
These general terms and conditions of sale come into effect as of the date of their publication: December 1, 2023.
